The Risks Most Fitness Programs Miss

Professional liability for trainers and instructors is frequently missing. A general liability policy covers premises injury, but a claim alleging negligent instruction, improper programming, or failure to supervise is a professional liability matter. Without that coverage, those claims can be uncovered.

Abuse and molestation coverage is sublimited or excluded. For any facility working with minors — youth athletics, gymnastics, dance, kids’ classes — this is one of the highest-severity exposures. Many policies sublimit it dramatically or exclude it entirely.

Waiver and release reliance is misunderstood. Many operators believe their member waiver eliminates liability. Waivers are useful but not absolute, and the policy needs to respond when a court doesn’t enforce the waiver as written. We don’t underwrite around the waiver alone.

Specialty programming creates exposures basic policies don’t address. CrossFit-style programming, climbing, combat sports, and obstacle-course programming all carry unique exposures that a generic gym policy may not contemplate. Specific scheduling matters.
